Scotland advice needed - query about post missives breach in house sale from
Hi
Writing this for a family member who doesn’t Reddit
Trying to keep details brief as don’t know who sees what
Family member sold house, missives concluded 31/7 pm and sale completed and keys handed over 1/8pm
From 4/8 until today (8/8) buyers solicitor has been giving us a laundry list of issues he wants us to give him money to fix
Not exhaustive list but includes: Alleged rubbish left, boiler issue, leak (wasn’t there previously as would have been noticed on carpets), blocked drain, seal needing fixed
Today he added wanting flooring ripped up and inspected for rot and water damaged
He wants all these things sorted by a cash lump sum (interestingly doesn’t seem to want family member to pay tradesmen to fix issues directly which whiffs of suspicion)
Some things have already been sorted or away to be sorted but now his solicitor wants us to pay buyers legal fees as well
All contracts were standard contracts and home report was done with no issues raised
Our questions
- how long exactly does the buyer have to raise concerns? Does completion day always count as day 1 no matter what time of day completion is?
- what sort of issues are you obliged to fix on a missives breach? Family member had no clue there were any issues and simply went off the home report
- are we responsible for buyers legal fees?
Thanks for much for your help!
