Medical LOA + Lay Off

Worked for a Canadian subsidiary of a US tech company. Employed for 3.5 years. Laid off with a package of 11 weeks and benefits in till the end of the month citing a ‘restructuring’ for the long term plan/vision. I was the only one impacted on my team of 13.

This is a great offer considering, however…..

I had submitted a Medical LOA for 4 weeks (my 2nd one this year due to ongoing medical issues) as soon as I got the note from my DR. This was not acknowledged by HR who are based in the US on PST. I heard nothing and followed up 2 days later to which I received a generic reply about ‘reviewing my request’.

Later that evening, I received an invitation for a meeting with my Manager and HR - I only saw the invite from HR as I was working late trying to finish my hand off for my LOA. I attended the meeting in good faith believing that it was a LOA kick off call - it was not.

I was laid off. On the first day of my medical leave.

A coworker had reached out to me that my former Manager had shared the news with the team but had also mentioned my role would be backfilled, causing a little confusion across the board. If they are backfilling, I imagine they will not post the role until I sign my severance agreement.

Im not sure any employment laws have been broken and believe that this is just bad faith. I know that I can be laid off at any time, really for any reason.

I have a consultation with an employment lawyer this week but looking for insight, anecdotes and opinions from fellow Redditors!
