Would this qualify for purchase protection?
Getting off a cab at the airport departures level and have 3 bags to unload (checkin suitcase, carry on suitcase and a duffel bag). Cabbie tries to help put the bags over to the side but trips on the kerb and ends up flinging the duffel bag over the railing while falling flat on his face.
By the time I got down to the arrivals level the duffel was nowhere to be found, presumably taken by someone or fallen into the ether. Lost & Found said they haven’t been handed anything yet but took down my info saying they’ll contaxt me if they do find it. Been 4 days so far without any response from them. I sent them a follow up email asking if they had any update but received no response.
Now, I would think this should classify for purchase protection since some of the items inside my bag were purchased during the trip itself. However the terms state the following:
“D. damage to, losing or theft while property is under the temporary care and control of a third party other than the Eligible Beneficiary, including a common carrier;
E. an item not being reasonably safeguarded, for example, leaving it in an unlocked vehicle or at an unoccupied site;
F. theft of, or from, baggage not carried by an Eligible Beneficiary or under the control of an Eligible Beneficiary or a traveling companion known by the Eligible Beneficiary;”
Could I be denied the claim since it was in the hands of the cab driver (even though for just a brief moment), and therefore being in “control of a third party” or “not carried by an Eligible Beneficiary”?
Would really appreciate any advice on the matter and if anyone has any experience with a similar situation.
