Case story. Seeking info.

So I just wanted to hop on here and share my story and see if anyone has had the same thing happen or any advice. I got married in 2020 to my husband and have had 3 kids since. He was currently here with a DACA and working but forgot to renew it and let it lapse and expire. I have been a stay at home mom since 2022 and he’s been working as a sub contractor. Since then we filed for I-130 in 06/2024. We just got the case approved on 08/22/2025. Now that I have moved to the next steps of the Affidavit support I’m seeing some red flags that started making me question. 1, I make no income but we have filed taxes since he gets a 1099. So I just now am figuring out that we were supposed to file a pardon or waiver for him under the I-601 form. That says on USCIS that it can take up to 35 months which will make the I-130 process expire. So now I’m stuck at this point and wondering if I’m going to have to start all over.
