Social Housing Subcontractor Liability
Good evening, I’m looking for some advice on where we stand regarding the liability in England of our “landlord” greensquare accord and their subcontractor.
Greensquare accord arranged for a subcontractor to carry out an electrical safety check in my home early August. They removed the oven from where it sits to inspect the wall outlet feeding into it and likely pulled it back too far. The oven didn’t work once they had left however after a small reposition it seemed to work again.
On Sunday the oven was turned on and I smelled burning. On closer inspection the outlet at the back of the oven has burnt out. Greensquare sent one of their own electricians out that evening. He confirmed that the oven had been rewired and the connection left loose. The relief pin that holds the cable in place had also not been reconnected.
Somebody has visibly cut the live and neutral cables and left the cuttings down the back of the oven. The electrician confirmed it was the subcontractor who had reconnected the oven wrong and caused the damage. Greensquare have contacted the contractor and they have stated that as checking the oven itself is not part of the electrical safety check procedure, it was not the subcontractor and they are not liable so will be unable to provide us with a new oven despite this being the original solution offered.
They are also refusing to provide us with a report of their own electrician’s comments or any certification surrounding the safety check or ability of the subcontractor sent to my home.
I have 3 kids to feed so I’ve already ordered a new oven with install and disposal, where do I sit regarding liability and the best way to reclaim my losses?
Many thanks in advance.
