I was fired for not calling in when I didnt have a voice
Hi reddit. Location: Dallas, Texas. I worked at a Chili's as a server for 3 years. I got (what I think was covid but never tested it) sick on a wednesday night, my day off, and was scheduled friday to serve at 11am. That wednesday night, I texted the group chat saying that I would normally call in, but that I was unable to because I did not have a voice. We do have a policy that you cannot use our group chat to call out and must call the restaurant, which I could not. For more info, our group chat has over 20 servers in it and ALL managers. When you first get hired there, they add you to the group chat without your permission and often give important information through the group chat as a source of updates on the company, such as menu changes, shirt changes, policy changes etc. Technically, there are two servers not in the group chat. Both are because they are high status, working at the company for over 17 years and sort of have special privileges. So while, Technically i guess you dont have to be in the group chat, you could potentially miss a lot of information if you dont or have that information only given to you weeks after everyone else knows. Anyways, I was in and out of consciousness for the next 3 days after that. I left one more message on thursday asking if anyone read my message about not being able to talk, then immediately passed out for over 24 hours. When I woke up, I had been kicked out of the group chat, and my schedule had vanished. To this day, no one has ever texted called or emailed me to say I was officially fired. Ghosted. I know I was though because my manager (screenshot from my other server friends) had publically shamed me saying I was fired on that group chat as a warning for anyone else who wanted to call in using the group chat. I spent the next 2 weeks and 6 days unable to get out of bed. Pretty sure I had long covid, I had a cough for over 2 months after that. It was awful and I felt like I was going to die. I couldn't even process being fired because I was too busy going in and out of consciousness for those two weeks.
Unsure if I actually had a caseI filed something with the Texas EEOC and, because they have so many calls, now today is the last day since the offense occurred that I can file a charge. They wont get back to me, and the reason I couldnt try to push for an appointment is everything was taken and I also got a concussion 3ish months after the incident, so obviously i was unable to file a charge. Is this legal? Can they do that? If not, how do I file a charge today since tomorrow will be the time limit of a timely charge and they wont get back with me?
