Fairholme vs FHFA Appeal

Any thoughts on the appeal filed this weekend? Honestly seems pretty negative for those owning commons right now. At the same time, it seems like such an insignificant amount to be fighting for in the face of making upwards of $300B in a potential recapitalization and release.
