Revocable living trust and will
In 2023 my husband and I set up a revocable living trust and will online. Following the instructions we did not registered the said document to city hall - my understanding was that we don’t need to.
Q: do we need to register?
At that time we didn’t have too much on our names besides jewelry. In the trust we did not specify exactly what jewelry we just said “engagement rings and any jewelry” we also did not specifically said what bank accounts we have we said “any bank accounts we might have at the time” . Now we have savings, Roth IRA and 401k, treasury bills and no property yet. The bank accounts some are only in my name some on both names. The money in all the accounts are marital money.
Q: is the above statement enough to cover everything in case something happens to one of us? I don’t want my husband or I to struggle if something happens to one of us.
We also have reciprocal power of attorneys and that we did register with the city hall.
Q: do we need to change the trust to be more specific on the assets?
Q: can 1 trust be valid with mutual and separate bank accounts? We don’t want some of the accounts to be on both names but we want everything in 1 trust.
For disclosure my husband has access to my bank accounts. I am not hiding anything from him. We just prefer to be that way. We don’t have kids.
