Potentially CIFAS Marker Due To Insurance Claim Misrepresentation

Comments Moderated

Hello,

I am after some advice regarding the above title.

So we had our home broken into and placed an insurance claim for the stolen and damaged items. One of the items stolen, I later found in the grass near my property. I uploaded the photo of the item to the insurance document to report it found but damaged I didn’t do it immediately due to other things going on such as police and family. Later that night the same van that was caught on CCTV the night of the break in was caught again on the CCTV (this was a week later after the break in)

I suffer with anxiety and mental health and this just put me into a frenzy and I ended up completely forgetting about contacting the insurance to notify them of the found item until I was told I was being investigated for misrepresenting the insurance claim due to the meta data on the photo. They had previously contacted me twice regarding this item which I failed to report found due to the impact the breaking in had on me and my family. My son who’s 4 hasn’t slept proper resulting in sleep deprivation, anxiety attacks & just sheer lack of appetite. I had just completely forgot about it and my mind was on other things like installing CCTV and trying to secure my property further

This item was only a £60 pendant that was on a chain. The pendant had personalisation on it but I only found the pendant and not the chain. So I’m guessing they seen the personalisation and took the pendant off and kept the chain so it be harder to identify.

Now the insurance has decided to cancel the policy and notify the CIFAS. I have taken this further with the insurance company and I’m awaiting a reply.

I’m due to remortgage my property in May and I’m extremely concerned that if they decide to not remove the marker how this will effect me going forward. As in will remortgage companies contact the insurers and ask what’s happened or will it be a case of struggling to get a remortgage?

My next step would be to speak with the financial ombudsman if my insurers were to refuse the marker being removed.

Any advice or guidance would be greatly appreciated as this was a genuine mistake on my behalf
