Committal for sentence from mags to crown court, England
Hi,
I’ll give a brief rundown. Please only answer if you know as I’ve been trying to find this out myself but can’t make much sense of the legislation really as this is all covered under the sentencing act 2020
I committed an offence in 2023 and elected to have trial myself in the crown court, although the case was suitable for summary trial. I eventually plead guilty and received a 10 week suspended sentence.
I breached that suspended sentence by committing a further offence, and was told this was a 8 week starting point, so again well within magistrates sentencing powers. Low and behold I received a custodial sentence of significantly longer than this (8 months, because apparently the category was two or three higher by the time of crown court sentencing which didn’t make sense as the case didn’t change whatsoever) anyway I digress
They committed this for sentence in the crown court, I was told that the only reason it got committed there was because I received the suspended sentence in a crown court. So I believe I may have been committed under s20(d) of the sentencing act 2020? As it doesn’t seem right I would have been committed due to the offence being to serious as the prosecution suggested it was a 8 week suspended, however please read https://sentencingcouncil.org.uk/guidelines/allocation-and-committal-for-sentence/ annex a section 7 it says the other offences still need to be committed under a certain power in the part where it says note:?
I surely shouldn’t be prejudiced by receiving a longer sentence than the magistrates would have been able to impose on me simply because I received a suspended sentence at an earlier date? As if I didn’t have this SSO it would have stayed within magistrates and they could only impose 6 months maximum…? Hopefully this makes ssns.
