MN: Ex and I have house together, she moved out. Questions about the mortgage moving forward
In April of 2022, my at the time fiancee and I bought a house together (dumb, I know). Unfortunately we broke up and she moved out January 1st of this year. I have been living in the house and making all the payments myself. I am renting out my basement now and don't have much trouble paying the mortgage.
Some basic information. Bought the house for $315K and there is about $295K left on the mortgage. We also got a first time homebuyers loan for down payment assistance that has about $10K left on it. I know that I can assume the mortgage but that can't happen until the down payment assistance loan is paid off.
We hadn't really talked much since the breakup, but she wanted to talk last week about moving forward and trying to get her name off of the mortgage, deed, etc. She seems to want to get all of this done soon. She asks me if I can pay off the remaining balance on the down payment assistance loan so that we can move forward with the process. She is also asking me about how I am going to pay buy her out and pay her the equity that she built up over the 3 years that we were together and both paying.
Questions:
- Even though she moved out, we are both still responsible for both loans, correct? I shouldn't have to pay off the balance of the down payment assistance loan all by myself?
- How does paying her the equity that she built up work out? Is she responsible for her half of the payments dating back to January even though she moved out?
- Any advice or help with how to proceed forward.
