Dealer won’t fix rattle issue on my Mercedes CLA 220d – what are my rights? [England]
Hi LegalAdviceUK,
I'm looking to understand my rights regarding ongoing issues with my car.
- Car registered 03/2023, purchased approved used 11/2023, still within new car warranty.
- Problems began after its first service in 03/2024, where the dealer damaged the speaker when cleaning the car. They fixed that but then cut a door seal, leading to excessive road noise.
- I had to take the car back 6-7 times for the seal issue as they couldnt get it right. Then the window started sitting oddly on the frame after repeated adjustments - that needed another 3-5 visits before it was resolved during the second service visit (a year later).
- Right after its second service in 03/2025, while driving back home, a new major issue appeared: a constant rattle/noise from the passenger vent while driving (video here). The dealer has been unable to fix it despite multiple attempts.
Where I’m stuck:
- I’ve gone back and forth with both the dealership and MBUK complaints.
- Complaints just send me back to the dealer, and the dealer keeps stalling with vague updates and no solution. No escalation path.
- I’ve asked for a buyback, replacement, or partial compensation for the repeated damage and unresolved issues, but I get no response. No date of resolution, nothing they're sharing.
My questions:
- Under the Consumer Rights Act 2015 or any other law, do I have the right to demand a replacement or refund, rather than endless failed repairs? How long can this take?
- What’s the correct escalation path if MBUK and the dealer both refuse to provide a solution?
- Am I entitled to any compensation for the repeated inconvenience and damage caused by the dealer? I'm expecting a baby and would like to be 'ready' when the time comes.
Any advice on next steps, formal letters, ombudsman, small claims, etc. would be hugely appreciated.
Thank you.
