Seller didn't properly disclose that the condo had major leak issue. Can I still sue after 5yrs?
For context I live in Mass. I bought my condo about 5yrs ago when I had to move and I only had a short window of time to find a place to live as the place I was renting was being sold. I thought I had found the right condo but now it has been nothing but a nightmare over the past 5yrs and I just want it to be over.
I had the inspection before I went through with the sale and the inspector said there is a minor leak issue but the seller said it would be fixed and not to worry about it. I had asked outright about this to the realtor for the seller and was told twice it was nothing don't worry. Seller had people hide it so well that it didn't really crop up in inspection. When I moved in, it looked fixed but it wasn't.
Months later in that summertime I went into the small room and saw that the wall was now a tanish color. Crack was there and it was wet. I wasn't sure who to contact on our HOA board so I reached out to management who sent out someone to take a look. The guy found out it was a water leak from the rains coming from the front steps and the facade of the building. Wall was SOAKED and he said it had been that way for more than a year it seemed with all the mold found. Sheetrock had to be entirely removed. He claimed to have pinpointed the leak and fixed it. a couple of years later it returned and was worse and mold all over the sides of the wall. Steps were so badly neglected that's why water was getting in, and the facade is also neglected. After months of battling with management they finally sent out a few people who had to remove the wall again and cut holes in the ceiling only to never return. We eneded up getting a new management company and it took a year before I finally had a manager who was willing to help the HOA take action on this. The steps have been properly fixed and my leak is almost all gone except for one small spot. Been reaching out to the management and HOA for the past month with no such luck on getting it properly fixed. I want to fix this once and for all so I can repair the damages inside my unit and sell the place to move somewhere else where I am not dealing with a leak issue. I can't sell it until this is fully fixed. I have to disclose this in the sale which I have no issues doing but I want to be able to say its been fully fixed not partically fixed. I don't want to put someone else through what the seller put me through.
Sorry for the long story but do I still have anything against the seller over this? It has caused me so much stress, anxiety and depression. It is making me not want to live there and I still have damages I can't repair until this is fully fixed.
