Theory on what happened to Hathaway's Jegan in 0093

I spoke before in a comment when asked about what if Amuro survived CCA and kept going in Londo Bell. And in it I mentioned Amuro would probably find out Hathaway killed Chan from his Jegan's flight recorder. Now, it makes me wonder why Londo Bell didn't find out since examining flight recorders is a standard military procedure. And I doubt Hathaway knew how to erase it. He could barely pilot an MS. Well, I have a couple of theories.

For one thing, the head mechanic Astonaige Medoz in Londo Bell was KIA in CCA, and the organization as a whole suffered heavy losses. Also, Londo Bell is an autonomous core that's more of a subsidiary to the Federation. This could mean that the flight recorders of the Jegans were simply not examined and later factory reset. Leaving Hathaway's flight data and his crime lost for good. There's also the possibility Hathaway's father Bright Noah had the data erased to protect him. But I find this idea a bit iffy since Bright was basically the moral police.

Here's another theory I find more probable. I think the Jegan Hathaway used was stolen. The paramilitary organization Birnam that had the Gundam Tristan also had Jegans. Several Jegans were stolen in the aftermath of the Axis Drop. And Hathaway was just flying his 'borrowed' Jegan around with it's hatch open. I'm betting the unit was stolen by a Birnam agent in the chaos after the battle had ended. It was a fully functional unit with it's hatch open and a kid at the controls. It was a prime target. This would mean one of the two purple Jegans we see in Twilight Axis may actually be Hathaway's Jegan. And if this is true, it would mean the flight recorder of the unit could have never been examined, and Hathaway completely got away with what he did. And being a kid at the time, it's possible the Birnam agent that stole the Jegan made sure Hathaway was safe on the Argama before taking off in it. Which would actually leave him with a positive impression of such people. And that may be in part why he became a terrorist years later.
