Question About FARE Act/Brokers Fee's

I have been living in my apartment for 4 years now and my property manager is FINALLY offering me an internal transfer to another apartment in my building. They are asking me to pay a broker's fee, along with potential painting/repair costs, even though I'm already a tenant and they hired the broker.

From what I understand the FARE Act says landlords who hire the broker can't pass the fee onto tenants. Does anyone know if this applies here, or if there's any loophole for in-building transfers?
