Can I challenge this car contract as unconscionable? (Maryland)
Hi everyone, I’ll keep this short.
Back in 2022, I bought a used 2019 Nissan Versa in Maryland. At the time, I didn’t fully understand the terms of the deal, and now, looking back, I believe I was taken advantage of. I’m currently seeking legal advice, but wanted to get a general sense of whether this might be considered unconscionable under Maryland law.
Here are the deal details:
- Cash price: $18,000
- Amount financed: $21,700
- Finance charge: $19,600
- Total of payments: $41,300
- APR: 23.75%
- Vehicle: 2019 Nissan Versa (former rental/taxi)
- Mileage at purchase: 54,368
- Location: Maryland
I now realize that the total payments are more than double the cash value of the vehicle. I was in a financially vulnerable position at the time, didn't have legal help, and the dealer didn’t disclose that the car had been used as a rental/taxi. Given these facts, is it possible to argue this contract is unconscionable or otherwise challenge it under Maryland consumer protection or contract law? I also signed an arbitration agreement as part of the contract.
