Setting up my first LLC for a production company
I’m in the process of setting up my first LLC for my production company and could really use some guidance from producers who’ve been through it. I don’t have the budget to bring on an attorney right now, so I’ve been looking at options like LegalZoom or ZenBusiness to help with filing.
I’m debating whether to form the LLC in Delaware or Indiana. Most of my filming will take place in Indiana, but I’m currently based elsewhere and working with a writer remotely in California. I know Delaware is popular for its tax benefits and legal structure.
I’m also torn on whether to name the LLC after the feature project I’m producing next summer, or use my production company name and file a “doing business as” for the project. The plan is to make a few shorts under the production company before the feature, but I’m not totally sure what happens with the company name and structure once that feature is sold.
Basically, I’m trying to make sure I’m setting things up in a way that keeps me protected legally, looks professional to investors and collaborators, and won’t complicate things later when the feature moves into financing or distribution.
Would really appreciate any insight or advice from producers who’ve set up their own LLCs — what worked for you, what you wish you’d done differently, or any pitfalls to avoid.
Thanks so much in advance.
