Found out that HR was acting against the law when they denied my accommodation request. Not sure how to best proceed.
Hi all,
I'm hoping someone may be able to guide me - this is a bit long, I tried to be as concise as possible. In April this year I declared that I have ADHD ( I also have autism, I just didn't include it at the the time because I wanted to see how they'd respond to my request).
Since declaring I have not received any accommodation, which i am entitled to in my country. I didn't really care to fight it before because at least I was working at home 1-2 times a week but due to a recent change in leadership, we now work on site everyday. This change occured 2 months ago and at the time I went back to HR and tried speak to them about reasonable accommodations. To cut a long story short HR wanted additional documentation/medical reports, I told them that I could pay for the consults but I could not afford the report on top everything else. They denied my request to pay, because I opted out of the medical insurance the company recommended.
This week I found out that if a company needs additional documentation to reasonably accommodate me, it should be at their expense and they can't force me to change medical insurance if they aren't contributing to the fees (which my job does not).
Now that the context has been laid, I'd to hear if it'd be in my best interest to also declare that I'm autistic before sending an email basically laying out what I've found to HR. I unfortunately can't go nuclear, if this has to go employment tribunals, I'll need to show that I made attempts to engage with HR.
