[England] Executor First-time Buyer Stamp Duty inheritance not yet transferred, still first time buyer?
Hi all, hoping for some clarity.
I’m one of the executors of my late father’s estate. Probate has been granted, but the title of the property is still in my dad’s name on the Land Registry — nothing has been transferred yet.
I’m now in the process of buying my first home, and I told a financial adviser yesterday that I “inherited a property,” thinking that was the correct wording.
However, after checking the probate paperwork and the Land Registry, I realised that I haven’t legally acquired the property and my name is not on the title.
My understanding now is: • Probate being granted doesn’t make me the legal owner • Legal ownership only happens when the title is registered in my name • Therefore I still qualify as a first-time buyer until/if that transfer happens
The property will ultimately go to my siblings, not me, so the title won’t be transferred into my name at any point.
Can anyone confirm whether that understanding is correct for SDLT first-time buyer rules?
