Are Judge Only Mental Health Act Hearings Legally Required to Be Audio Recorded?

Healthcare

I’m hoping someone with experience in NZ law or mental health proceedings can help clarify something.

When a judge-alone hearing is held under the Mental Health (Compulsory Assessment and Treatment) Act, specifically for a Section 16 review/request, is there a legal requirement for the hearing to be audio recorded?

If so: • Which legislation, regulation, or court rule sets out this requirement? • Is the recording automatically kept on file, and can the patient (or their representative) request a transcript? • Are there any circumstances where a Section 16 hearing would not be recorded?

Any guidance, official references, or experience from lawyers, advocates, or people who’ve been through the process would be appreciated.

Thank you!
