Brother passed away, late to inform ODSP
Hi everyone,
My brother passed away at the end of September. It aas a very difficult time for us and I didn't even think about informing everything from the CRA, NSLC to the ODSP. I had informed the bank to close his accounts mid October. I think they had opened an estate account. He had no will, no spouse or kids, no other assets other than whatever is in his bank account and lots of debt (line of credit). The bank told me they are listing me as the executor and that I should apply for probate which I have not. I don't want to get into the legal mess of this as I think it would cost me a lot in legal fees and I don't have the time for all these documents and requirements etc.
My questions are: Can I just drop off the death certificate to ODSP and be done? If there was an overpayment can they not just get it from the bank? Do I have to legally become the executor and pay back ODSP through his estate account with the bank?
I just want to avoid being the executor. I think my brothers taxes have to be filed as well for this year but if I help file them will that count as doing the actions of an executor?
