Can I make a legally binding contract with my roommate to take them to court if they do not pay their half of rent?
Location: Michigan
I think the title explains the big question. But to elaborate more, my roommate and I (she is the primary applicant if that changes anything), have lived here for a couple months now and things were fine until now. The other day she said that she wants to move out right away, and she has not paid the electric bill (which is in her name and I already paid her my half of it) or her half of the rent. I am worried that she is planning on not paying rent to get evicted so she can move out immediately because she knows that I can't afford to live here on my own. Talking civilly about this issue isn't much of an option because she has been getting incredibly defensive when I try to discuss apartment related issues with her. I want to know if I can make a contract saying that if she fails to pay her agreed upon amount of rent that I can take her to small claims court or something of the sort. One, so there's an incentive for her to not get us evicted, and two, so that if she does I at least get something out of it.
