Advice on Trademarking App Name (England)
Hi all,
I have been developing an app for a while now and as it approaches a potential MVP state and I consider my options regarding things like branding I have been thinking of registering a trademark for the proposed app's name.
I have looked into the process and conducted some searches regarding potential clashes with other trademarks but I'm having trouble finding any concrete information on what is considered "too close" to another trademark in certain circumstances.
For example:
Say I have searched on the UK IPO web tool using relevant keywords and variations of my app's name "Mesafor" in classes 9, 35, 38, 41,42 and found an international filing under the name "Metafor" and a UK based filing of the same name.
The international filing is a larger multimedia company who have a news publication website but the only relevant goods they have registered in any category is class 9 downloadable mobile applications with the rest being centered around news, current events and the likes.
The UK based metafor has Class 42 downloadable software registered.
I would be looking to register against virtually every mobile app, downloadable software and social media related goods and services I reasonably can within the aforementioned classes.
In this case is it likely that I would run into trouble regarding the initial filing of the trademark? Obviously, I would always run the risk of the larger companies arguing I am diluting their existing IP but besides that what are the main considerations in this scenario.
Thank you for reading.
