Landlord refusing to return my 105k deposit unless I stay another year - is this legal in the Philippines?
Hi everyone, I need some legal advice regarding my condo lease in the Cebu City, Philippines.
I originally signed a 12-month lease that ended on September 23, 2025. After it expired, we agreed over messenger that I would stay an additional year (until Sep 23, 2026), but we never signed a new contract. We also agreed on a new rental rate of 36k over messenger, and I’ve paid everything on time for the past two months. However, things have changed in the building that are out of my control so I want to move out.
Now that I want to move out, my landlord is saying they won’t return my 105k deposit unless I stay until September 23, 2026. There was never any written agreement to extend the lease until that date, only a verbal understanding that I could continue month to month.
Can they legally keep my 3 month deposit even though we never signed a new lease? What are my options to recover it if they refuse to return it?
Would appreciate any help or references to Philippine lease laws.
