Looking for Advice: Toronto Rental, N9, and Rent Owing for November
Hi everyone, I’m hoping someone familiar with Ontario rental rules can help me understand my situation.
I’m renting an apartment in Toronto. My lease was for 1 year, and after that it switched to month-to-month.
I recently found out I have to leave Canada earlier than expected, so I planned for November to be my last month.
The issue is: I didn’t know I needed to give 60 days’ notice for a month-to-month tenancy. I informed the property management about 45 days before the end of November and told them I wanted to use my last month’s rent deposit to cover November. They told me I needed to sign an N9, so I did, and I emailed it to them.
Now it’s November, and they just sent me a warning saying I owe November’s rent and that if I don’t pay it, they will apply for eviction with the LTB. The notice they gave says the termination date is November 19.
My main concern: Can they force me to leave before the end of November? I’m leaving the country at the end of the month and I need time to pack my things. I’m not trying to avoid paying — I just honestly didn’t know about the 60-day rule and I thought my last month’s rent deposit would cover the final month.
Any insights on whether I can legally stay until the end of November (or at least until my move-out date) would be really appreciated.
Thanks in advance.
