Boots listed as excellent condition disintegrated on first wear - grounds for refund or return?

Advice Needed

As the title says, received shoes that were listed as excellent condition; however, they totally fell apart within the first hour of wearing them due to the glue having been totally disintegrated. Seller is saying it’s never been worn and looked new. I’d argue it’s the sellers responsibility to check for things like the sole being properly glued to the body of the shoe before listing as excellent condition. Will Depop typically intervene in events like this?

Thank you!!
