Not accepting shipment (?)

So I'm in a kind of an awkward situation and I'm not sure what to do, so any advice would be appreciated:

I made a tracked order from a private seller. 6 days after paying (trustee method) he marked the item as sent but without a tracking number, so I waited a day and then asked him about it through PM. Having received no reply for two days I ask him to cancel my order in the case he hadn't actually sent the item yet (it's a gift and i need it fast). Two more days of no replying and then he finally sends it, of course the tracking saying he sent it on that very day, 10 days after payment and 2 days after asking for cancellation.

Now, seeing as it is tracked and protected by the trustee service, can I just not accept the package? Will that result in both him getting his cards back and me my money back? Or is there an alternative in me getting my money back?
