Unmarried in Ohio - is it likely I'll keep custody and have my ex get visitation? What about domestic violence?
Location: Ohio
We were never married. My ex was abusive towards me and our child. My ultimate regret is not leaving sooner. But he would threaten me with court to take our child if I did. He would also cite change but then no change ever came.
Now that we've been separated, my ex is taking me to court for residential and custodial custody. Our pre-trial is this week.
I do have documentation against him. I have a large written log I began when he first started getting aggressive during my pregnancy. I have videos of him spanking, yelling at and cussing at our child. He does not know I have this documentation.
I went to the police finally after we separated but they weren't much help. I do have a report though. I did get a lot of help from online DV advocates and advocates around me. They helped validate that me and our child did experience abuse.
I have sent all pics, videos, etc to my lawyer. We met up last week and she requested I send her everything. She also was very disturbed by the videos and my ex's behavior. I allowed supervised visits out of concern for our child's safety. He made the comment that he wasn't trying to take our child and not bring them back one time when trying to get me to allow an old unsupervised visit and that really scared me.
My ex randomly blamed me for us going to court (said it was because I wouldn't let him see our child). He has been no contact ever since. My lawyer said he set himself back by doing this unnecessarily. She also said to her, he needs to prove himself to me and our child. Our child is 14 months old, so they really don't know their dad. Dad definitely doesn't know anything about them either. My lawyer thinks I have a very good chance at keeping custody basically how it is where the child lives with me and I handle the decisions. With legal. I prefer that to be solely me too unless it's very serious to minimize conflict and contact with my ex. I also feel my ex should have to do anger management and/or parenting classes for young children if he ever wants unsupervised visits. For now, I think he should have supervised only. Then if he completes his courses, see about giving him every other weekend or something.
My lawyer thinks that is reasonable but I'm scared because the judge makes the decision. How likely am I to actually get what I am asking for in this situation?
Also, I found out DVPOs exist (domestic violence protection order). I may be able to get one for me and the child. Now, could I still do that this close to pre-trial? Could I still do it after pre-trial? I wish I could have found out about it sooner. I don't know how all this works though because I'm new to all of this.
