Help , i was scammed by a local phone seller as he sold me a refurbished phone even though I paid him for a new one

So as S23ultra is a very good phone ,i bought a global version of it from a local seller cause he himself suggested that it's new and has no problem except that I will get no warranty apart from it it's completely sealed and new and my old phone was broken so I needed one urgently. So i bought it and he did not give me a bill , ( I do have the Google pay transactions). Now after checking the system logs of the phone I have found that the phone has a battery health of 90% and the phone has been charged for atleast of 800 times The phone's body kit was changed and replaced so there was no way anyone could know that it's refurbished. , so how can I use him for selling me the phone by lying and taking 55000 and giving the a 2yeards old used and refurbished phone that has a used and bad battery.
