Can I send my ex a 93A demand letter in Massachusetts for failure to pay me back?
My ex owes me a ton of money ($1,700+). I want to send a demand letter before filing a complaint in small claims court. Would this demand letter be enforceable under MGL 93A since he is an individual and not a company?
Location: Massachusetts, USA
Main points:
- money damages I want repaid were explicitly not gifts
- first incident occurred on 10/27/2024 and the most recent dispute ranges from September 2025 - November 2025
- He sent me texts writing that he would pay me back
- He verbally agreed to pay me back
- each recent time I've asked him to pay me back and how he agreed he would, he disregards it and calls me slurs and hurtful names and brings up irrelevant reasons why we broke up.
Other info:
- I have all of our text messages and phone call history since we met September 2024
- he was stealing parts from his job and selling them on ebay
- he was driving drunk in a company care he signed a contract that agreed not to use it for personal use (he had been doing so for years), hit another car and wrecked the company car, refused to pay the tow truck driver and was verbally aggressive with him (I have the tow truck number and name and he talked to me that night and was on my side), I have the RMV information and phone numbers of the people who's car he hit, and was subsequently fired from this job, then proceeded to collect unemployment in MA but then work for his dad and get paid in cash in Connecticut.
- he is 32
Any suggestions besides going straight to a lawyer? I work two jobs and I am struggling to make ends meet, so giving up on this is NOT option.
