Verbally approved today! Overstay was not an issue.
Hi all,
My wife and I had our interview for her AOS case in San Antonio, TX. We would like to share our experience since we have seen a lot of anxiety regarding ICE arresting spouses of US Citizens due to visa overstays.
She came on a B1/B2 visa in August 2024, we married in December of 2024 and filed March 2025. She overstayed her I94 by 40 days before filing due to a delay by Boundless Immigration (I chewed them out thoroughly).
The officer who interviewed us was very laid back. He asked me what day we got married and where the ceremony was held, asked for evidence of cohabitation (lease with both of our names on it, bills, etc) and I also provided him with our pay stubs showing the same address and joint bank account statements. He asked my wife where she worked and what a typical day is like at her job. He then asked her a bunch of yes/no questions (the same ones on the I-485). He also asked if we had kids and we told him we are expecting our first child and showed him the pregnancy ultrasound. The entire interview lasted about 20 minutes and he did not bring up the overstay at all. He then verbally approved us and congratulated my wife on being approved and on the pregnancy!
Every case is different and it also depends on your FO and officer conducting the interview but they are NOT arresting everybody for overstays. Just make sure you go prepared and it never hurts to have your lawyer present if necessary. We did not have a lawyer.
