Ex won’t sign spousal RRSP transfer forms — stuck with her account in my Questrade login?
Separated from my ex (common-law) in late 2023. I had contributed to a spousal RRSP for her at Questrade. The RRSP is in her name, but it still sits inside my Questrade login because I was the contributor.
To transfer it out, Questrade needs:
- T2220 (signed by both of us)
- Letter of Direction
- A document confirming the separation
I gave her everything back in Jan 2024 and have followed up several times. She just never completes the forms. Her lawyer has since withdrawn, and she’s gone silent.
Questrade won’t let me close my profile while that spousal RRSP is still attached to it. I can’t move it or close it because it’s legally her account.
Questions:
- Am I stuck with this spousal RRSP in my login forever if she never signs?
- Does leaving it there create any tax or legal risk for me?
- Can Questrade move it to a separate profile in her name without her doing anything?
- Any way to force movement of the account without going to court?
Thanks.
