Questions About SOWP Application for My Fiancée
I'm reaching out to inquire about the process required to apply for an Open Work Permit (SOWP) for my fiancée, who is set to become my wife in a couple of months.
Context:
- I'm a temporary resident in Canada, holding an Indian Passport.
- I entered Canada on December, 2023, for my Master’s Degree and graduated on August 2025, from a DLI-listed school and immediately applied for a Post-Graduation Work Permit (PGWP).
- I’m currently in maintained status while awaiting a response from IRCC. My previous study and work permits are valid until December, 2026.
- I hold a full-time TEER-1 position in Ontario.
- My TRV is valid until October, 2033.
- I’m set to marry in January or February 2026 in India.
- My fiancée is also an Indian citizen, currently without a TRV, and holds an MBBS (Bachelor of Medicine, Bachelor of Surgery) from an Indian university, with relevant work experience in a field that does not require a medical license. We’ve been in a long-distance relationship for five years and want to spend time together after the wedding.
My Questions:
- Is she eligible to apply for an SOWP while I’m holding a maintained status? Will she need to wait until I receive my PGWP to apply?
- Should I update my PGWP application if my marital status changes before I receive a decision?
- She is eligible for NOC 32101, 33102, and 13112 jobs in Canada. How can we mention this in her application, or will it be up to the officer to determine her NOC?
- If we legally marry under Indian law and present proof of our marriage along with our relationship documentation, will this be considered valid for her SOWP application, even if the ceremony occurs later?
I appreciate any insights or experiences you can share!
Thank you!
