Reselling Something that was Refunded

hello, I'm kind of new to Depop and i just need some quick advice. to make a long story short, i bought a windbreaker in "excellent condition" with no signs of defects. when i got it in the mail i saw there were pink stains all over it that weren't in the pictures. i ended up asking the seller if i could send it back for a refund and they said they would. when i put in a dispute, they never responded so i ended up getting my money back and didnt have to send it back. i was wondering if it would be a bad move to resell it? i would definitely advertise it with all of its defects, i just dont know if its messed up or not to sell something i technically didnt have to pay for.
