Property owned 50/50

Location: Kentucky

So my husband owns 50 percent of a home his brother the other 50 percent. He wants full price for his half and honestly it not worth that with the bad shape it's in inside and outside and we don't have the funds for court and his little brother wants it to go to court so can we sell my husband's half only the half to someone else as long as they know they will only get half?
