Annoyed

My dad is moderately famous in my state for playing sports 50 years ago. I am desperately trying to find a job and the last 2 interviewers brought up my dad during the interview. I don’t even have a relationship with this man. He was a dead beat who abandoned my mom and I, barely in my life, and only when it served him. I normally avoid the topic at all costs but because of my last name I have to deal with this major distraction during my interviews. I miss living outside of my home state sometimes. Is this even legal?
