The New Marriage Law of 2025

The distinction between joint property and personal property of spouses

Interpretation II of the Marriage and Family Code of the Civil Code shall come into effect on February 1, 2025.

The scope of joint property between husband and wife includes post marital wages, bonuses, operating income, inheritance/donations (not clearly attributed to one party), etc. Both husband and wife have the right to jointly dispose of joint property.

Personal property scope: Pre marital property, personal compensation for damages, will/gift (clearly to one party), specialized daily necessities, not to be divided in divorce.

Principle of division: protocol priority; If the agreement cannot be reached, the court may make an equal or unequal division based on the rights and interests of the child/woman and the innocent party.

Fault and Hidden Assets: One party conceals/transfers/squanders joint assets or forges debts, with less or no division when dividing.
