No holiday pay and unpaid OT
Hi everyone. I’ve been working in a tutorial center for a while now as a regular employee, working 6 days a week. Lately, I’ve heard complaints from my coworkers and I’ve noticed issues myself regarding our working conditions.
Here’s what’s happening: • We always work on holidays, and when I asked my boss about holiday pay or double pay, I was told that we don’t have holiday pay, double pay, or even the 30% premium for special non-working holidays because we are “less than 10 employees.” • But the company now has 3 branches, and if you combine all the branches, we already have more than 10 regular employees, not counting the part-timers. • Our lunch breaks are often less than 1 hour sometimes only 30 minutes but the system still automatically deducts 1 full hour, even if we didn’t take that long. • We also have unpaid overtime, even when we’re clearly working beyond our scheduled hours. • On December 30 (a regular holiday), we were open, and we were told to file a leave if we didn’t want to report to work which feels wrong because it’s a holiday, and filing leave shouldn’t be required.
I’m starting to wonder if all of this is a violation of the Philippine Labor Code. Can someone please enlighten me or confirm whether these practices are legal?
Thank you in advance.
