Why doesn't doh king down on poor performance and failing large blocks of s class work?

You hear about districts transferring "problem teachers" who literally abuse kids to other schools. So if you do something much less wrong like honestly fail kids who perform like failures and spend your class period criticizing ones who don't pull their weight as well as teaching -- what's the worst that can reasonably happen besides a contract not being renewed at the end of a year?
