Equifax damaged my financial relationships, deleted part of my credit history due to their error, refused to correct it, what can I do?
I must either have really bad luck or I may be doing too much to where this type of stuff happens to only me, but this is what happened before things hit the fan:
An old friend of mine had went through my property and stole from me, including one of my credit cards; used it, spent on it, even tried to cash advance by adding money to their PayPal balance. Not sure if they copied down information or took photos of other things they found when going through my stuff but the following happened:
Months later there were a bunch of inquiries on my credit report. I contacted the banks that reported the information and they all said one of the two statements, that there was an application and no account was opened, or an application was submitted and that it failed identity verification.
My credit score additionally dropped bc of how many inquiries there were, so I disputed them. But Equifax is what is bringing me to tell you my story today.
Equifax denied my dispute with the reason that everything I was just speeding was accurate and must remain on my credit report for two years. I called them and asked what evidence they received for them to claim that this information was accurate because half of the banks that received applications told me that it failed Identity Verification. So I was confused how they were coming to the conclusion that everything was accurate?
They told me that I needed to submit a FTC Report, which ChatGPT told me is them being lazy and not conducting a reasonable investigation although they were required to by law.
But fast forwarding to me completing my FTC report, I decided to deliver it to them by adding it as a file attachment in my CFPB complaint against them for not doing a reasonable investigation (which is why I stated in the beginning of this post, that this may be happening to me because I’m doing too much). But I felt doing it this way was appropriate since the inquiries remained on my report during the interim and was negatively impacting my credit score.
Now for the reason I’m writing this, in my FTC report, I included all of the persons information in the suspect section in addition to my American Express card that they stole and charged up, but under the “Fraudulent Information on credit reports” section, only listed inquiries, no accounts. And on the FTC portal one making this report, I explicitly selected “No” wanna ask if they were fraudulent accounts I identified on my credit report.
So Equifax got my CFPB complaint with my FTC report attached and they decided to dispute all of my American Express cards on my credit report as fraudulent accounts When contacting them, they said because the account was in my FTC report they had to include it, but because I didn’t specify an account number they disputed all of them. Which I countered by saying that the reason I never included an account number was because I wasn’t disputing any accounts, I never stated in my personal statement that I didn’t open a specific account or that the account wasn’t mine, it was included because the form asked about suspect information, and I included the account under the section “Accounts included in the crime” when detailing the crime the suspect did to me, only detailing they stole my card and fraudulently charged it, never once saying they opened it.
Equifax denied the ability to withdraw this dispute or rescind the incorrect portion and now I’m extremely worried if Amex is going to close all my accounts with them because of this and I have absolutely no idea what to do because I’m only 25 and if Amex decides to do that because of this that’s going to seriously hurt me until I’m able to build my credit file back up which will take years because of the “average age of accounts” portion of what makes up a credit score.
I’ve seen a lot of stories on here and a lot of smart people but what are my options like can I sue Equifax for violating my rights under the FCRA and disputing information that was valid that I never reported, including denying a way to correct it? If Amex did close my account I’m very positive I can sue for damaging a financial relationship but do I have any options in my current position? (I informed Amex already and they said to correct it with Equifax although I’ve already explained how useless that way)
