Deed Restrictions into Perpetuity

Location: New York

In 1903 a family sold 150 acres of land to the city.

They wanted that land to remain open, green space into perpetuity and place deed restrictions indicating such intent.

City is now landlocked with a low housing stock.

We, a local family and a friend, have raised our initial offer to buy the land in 2022 from 700K to 1M.

Our intent is to develop affordable single family homes.

— The family originally settled in 1746 and acquired this land after General Sullivan’s Expedition around 1757-1759 took the land from the Natives by force. They then called it their own.

We are exploring legal angles as to the validity of this deed and its restrictions given how the land was…”acquired”.

Does the tribe, which still exists in this area, have any claim to this land? Though around for thousands of years, this tribes confederacy formed in the 1400’s.

Settlement began around 1778, our city was chartered in 1894, and incorporated in 1895.
