Quit claim deed rescission
I have consults set up with a few different attorneys already but want Reddits opinion
Hi Reddit, I’m looking for advice about a family/property situation. My grandfather’s will left some land to my dad, but my dad’s brother ended up receiving it through a quitclaim deed via my dad. The deed was for zero dollars, and my dad says he signed it under duress and harassment.
The circumstances were extremely stressful. My uncle is emotionally abusive and has a history of drug use, threats, and verbal abuse. The quitclaim deed was signed immediately after my dad sold my grandfather’s house. When my uncle found out about the sale, he got angry and demanded a some sort of payment or property. Over a long period of time, he harassed my dad with many, many messages, saying he was owed something and using emotional manipulation and coercion to pressure my dad into giving him the land.
The deed was recorded in December 2024, and my dad is on disability, which may have made him more vulnerable to this pressure. He did not gain anything from the transfer, and the property was supposed to be his according to the will.
He wants to know if it’s possible to undo the deed and regain the land, potentially through a constructive trust or other legal remedies. He’s also curious about whether filing a lis pendens would protect his rights while pursuing this. Has anyone dealt with trying to rescind a recorded quitclaim deed due to duress, emotional abuse, or undue influence? Any guidance on next steps, legal strategy, or working with a lawyer for limited-scope help would be really appreciated.
