100% P&T w/ CUE
So, I got out in 2017 and had all my initial rounds of claims. Was diagnosed with degen arthritis in back and knees. Service connected for knees and denied for back and sleep issues.
On my initial claims and in my exams it was noted I had locking, clicking and instability in my knee, however was not rated for it.
Skip ahead to present day, I finally got with a lawyer and wanted to get everything taken care of.
Rated for both knees still, as well as instability w/ brace. Also service connected for my back, bilateral radiculopathy and insomnia sleep issues. I am 100% PT.
My lawyer has filed with the BVA contesting that there was a CUE im 2017 and 2018 with my back and knees with the conditions being present and diagnosed at the time of exam that I should be rated for the instability retroactively as well as for the back due to the assumptive clause of the back arthritis within 12mon of discharge. Furthermore, I had documented sleep issues in service as well as during my sleep study.
While it would be AWESOME to recieve the backpay from 2017-2023 I am concerned that this opens me up to removals of service connection and reductions from the BVA.
What are your thoughts? Let it ride, or what do I do?
