Should I file a small claims or civil suit?
Location: Orange County, California.
Location: pharmacy is in the city of Santa Ana, California.
Location: Los Angeles County Doctors
Question #1 - is should I file small claims suits on my own against 3 doctors and the pharmacy OR Should I lump them all in a Large Civil Suit?
Question #2 - I've tried calling medical malpractice, personal injury, and fraud attorneys so far. What area of law would this fall under?
Question #3 - Where would be the best place to find a lawyer for a case as niche and weird as this?
While I was intubated in a Newport Beach ICU, during this time someone filled a 60-day buprenorphine script at a Long Beach, California pharmacy in my name and billed my insurance; I have the CURES report + insurance EOB. Hospital, 4 subsequent LA/OC doctors and the pharmacy are still writing a laundry list of narcotic medications and the pharmacy fills them every month despite exhausting all documented efforts. So every new prescriber refuses me a 30-day supply; I’ve been wheelchair-ubering to a daily-dose clinic from Santa Ana to Fullerton $100 a day for 9 months. And to top that off I can't seem to find a job with a employer that's ok with the fact I can't show up till 11:00 AM to work due to having to got to a clinic (and, I don't blame them I'd feel the same way about someone trying to get a job for my company.. i wouldn't hire me). I’ve filed FTC, DEA, PD reports but the script keeps refilling. I want one lawsuit that makes them (1) correct the record, (2) cover continued daily-clinic costs, lost wages, future care, and (3) penalize the forged Rx chain. Is this straight med-mal, ID-theft tort, or fraud?
