Would this be classed as misrepresentation?

Serious Replies Only

Hi all,

I am aware of the usual law around buying vehicles from private sellers and what your usual rights are as a result.

Basically, bought a van and the seller clearly stated in their advert "recent clutch and leisure battery" when speaking to them, they confirmed that these were both replaced by the previous owner recently implying that they should be good for a while. Long story short, had the van less than 3 months, done less than 500 miles in it before battery light and stop appeared on the dashboard and the clutch has gone on the van, confirmed by the garage it is currently in. Seller has no proof from previous owner via receipts that either of those things were actually done, stating they just took their word for it.

Is it grounds then that they have misrepresented the condition of the van as they should not have stated recent clutch and battery when they couldn't prove that and the clutch has now gone within 500 miles of me having the van?

Appreciate any help.
