Is the Supreme Court a Domestic Enemy of the Constitution?
Chief Justice John Marshall used a case where he admitted the Court had no jurisdiction to seize the power to define the Constitution for everyone else.
Marshall ruled that Section 13 of the Judiciary Act was unconstitutional because it expanded the Court's "Original Jurisdiction."
If the Court had no jurisdiction, the case should have ended immediately. Instead, Marshall spent pages lecturing the President and then "invented" Judicial Review to ensure that, even though he "lost" the battle for Marbury’s commission, the Court "won" the war for ultimate power.
Thomas Jefferson’s deepest fear, if the Court is the final arbiter of its own power, the Constitution is a "felo de se" (a suicide pact), has come true.
Congressneeds to use it's Constitutional Power to limit the Court (Article III, Section 2, Congress has the explicit power to limit what the Court can hear.).
