Ordered a new phone, was sent a refurbished phone

I ordered an iPhone 12 mini (I know it's an old phone) from straight talk when there was a promo going on for $120.

The listing did not mention used/refurbished anything. So I assumed it would be a new phone with bad battery stats (which is fine).

On Dec 21st, when I activated the phone. The settings section showed that the coverage was expired. When I reached out to Straightalk they said send apple the purchase details and they will fix that. Apple asked me to wait for a couple of days because I had just activated and sometimes it gets fixed on its own.

Today, I see that it still showed Coverage Expired. So reached out to apple support over phone and they said this is a refurbished phone which was first activated in 2022 and it's warranty ended in 2023 July.

When I talked to straighttalk support, the lady agreed that I was sent a refurbished phone and there is nothing she can do one her end. She has to escalate it and scheduled a call for 4:30pm. But I never received the call.

What are my options? I really wanted a mini iphone :(
