Benefits : LTD and EHB. Requesting for guidance please!

Employment

Hi,

I am seeking guidance to help my wonderful and caring neighbor with a difficult employment and disability situation due to brain hemorrhages. He will be turning 65 in April 2026.

Brief background:

He has a full-time, well-paid job with Extended Healthcare Benefits (EHB) in Ontario Canada but, it is very high-stress job. In early 2025, he was hospitalized due to serious brain hemorrhages and developed a disability.

He has been off work since then and is undergoing treatment and rehabilitation. He is currently receiving Long-Term Disability (LTD) benefits through his employer.

As per his employer, under the employer’s policy, his LTD will end when he turns 65 (in April 2026). The employer has also advised that EVEN his EHB ALSO will also end in April 2026 (at 65 years of age).

The employer has given two options:

1: Retire at age 65, or 2: Decline retirement and apply for EI.

He did not plan to retire at 65 due to ongoing responsibilities. His hope is to recover and obtain medical clearance to return to his same job. However, he is concerned that if he retires at 65 and later recovers, his age may prevent re-employment, including with his current employer.

Questions:

1: What general suggestions or options should be considered in this situation?

2: Can any employee (who is already on LAT for more than 52 weeks) is even eligible to apply - get for EI? OR it's employer is flipping him to "may" be EI?

3: If he opts for "not to retire at 65 years of age", can employer fire/let go him?

4: Should he opt for free legal aid services in the GTA that focus on employment and human rights?

5: Should he opt for any free employment or human rights lawyers in the GTA who could review his case and provide guidance, until retained on contingency fees?

Thank you very much for your time and guidance in this situation.
