RTA: not at fault, injured, comp claim advice please
Scottish Borders, Scotland.
I’m looking for some advice please,
I was in a road traffic accident 7 weeks ago. I was stopped in a queue of traffic on a 60mph road and about to move off when someone crashed right into the back of my car. The guy immediately accepted fault. The police were called, I went to a&e with neck, shoulder, back and arm pain. The doctor wasn’t sure how long the wait would be to get an x-ray at the time as he had suspected a cracked rib toward my back. I’d been in a&e for 4hours at this point and it was extremely busy and there were warnings for flu in the hospital the day before so I wasn’t wanting to be there longer than I needed to. I agreed I’d go home then and contact my GP. The a&e doctor gave me codeine pain meds and told me to rest, he said give it 4-6 weeks (given I don’t feel worse) and if I were still in pain the doctor can request an X-ray. He advised going to see the GP even if the pain was better just to get properly checked out.
My car was deemed a total loss. The insurance company were awful. They provided me with a courtesy car and wouldn’t release my payment until 3 days before they were due to uplift the courtesy car. They were supposed to collect the car 2 weeks ago now, instead they messaged at the end of the day of collection to say they can’t collect that day. I’ve heard nothing since about them getting the courtesy car and the company are a nightmare to get through to.
Anyway… so many people have said I should claim for compensation but I really don’t know how I feel about it, is it a waste of time claiming? I see the GP for the first time in 2 days. The area of my back still hurts a lot and both my neck and back feel like they are getting worse. I had time off to rest for Xmas and NY but I’m working and unable to take time off as I have a young family to provide for and I’m the main earner.
Looking for people who have had similar situations? Did you claim? What happened? I’m so conflicted by what I should do and what is the right thing to do.
Thanks in advance
