San Diego PD Now Using SoToxa Saliva Tests During DUI Stops

Posting this for awareness.

The San Diego Police Department is rolling out a new handheld saliva screening device called SoToxa that officers can use during traffic stops to test for drug impairment on the spot.

What it tests: SoToxa uses a simple mouth swab to screen for THC (marijuana), methamphetamine, cocaine, opioids, prescription meds, amphetamines, and benzodiazepines.

Quick results: Results are available in minutes — but it only reports a positive/negative result, not how much of a drug is in your system.

Voluntary test: You can refuse the saliva test — there’s no automatic penalty for doing so. Officers reportedly use it as a preliminary screen.

What happens next: A positive result doesn’t automatically mean a DUI charge — it often leads officers to pursue confirmatory blood testing with stronger legal weight.

Why this matters: Unlike a breathalyzer, California doesn’t have clear legal “drug limits” like a 0.08% BAC for alcohol, so drug screening laws and outcomes can be complicated.

Legal tip: These saliva tests are often used to build probable cause for further testing — not as the final evidence. If you’re stopped and asked to take one, politely declining is an option, but officers may then pursue other evidence or tests. Always know your rights.
